ED WYNN - AUTOGRAPH NOTE UNSIGNED CIRCA 1936 - HFSID 46970 ED WYNN Ed Wynn wrote this unsigned letter, saying that a 1936 letter that he received from Uproar Company was "some kind of a holdup". This was in regards to a 1932 contract that he signed with Uproar to publish his scripts for the radio show The Fire Chief. Autograph letter unsigned written in red pencil or crayon. 1 page, 8½x11. In full: "I think the 'Uproar' letter from those Boston attorneys is some kind of a holdup - If I remember the letter, there is something about me not having the right to publish the 'Uproars' while I was with Texaco and that I had no right to sign the Contract in the first place - I don't know how they arrive at that conclusion - In fact I do not understand the letter at all unless as I say it's a holdup -". Lightly toned and creased. Paper clip impression and rust stains at top left corner. Folded twice and unfolded. Otherwise in fine condition. Accompanied by two items: 1) Typed letter signed by Bernard Berenson. 1 page, 8½x11, on letterhead of Arthur Berenson and Bernard Berenson. July 20. 1936. Addressed to Ed Wynn c/o Keenan Productions, Inc. New York City. In full: "Dear Sir:- You are no doubt aware of a suit brought by the Uproar Company against the Texas Company [now Texaco] and the National Broadcasting Company for conspiracy to interfere with the plaintiff's business of publishing and distributing the so-called 'Uproar' pamphlets based upon the script which was used by you on the Texaco Radio Program. The Uproar Company derived its right of publication under an assignment from Peter M. Leavitt, dated November 5, 1932, of all his right, title and interest in a contract between you, Keenan Publications, Inc. and Mr. Leavitt. The claim of the Uproar Company was diligently prosecuted by us as counsel and went as far as the United States Supreme Court, where certiorari was denied May 4, 1936. As a result of that litigation it now seems clear that you, as author of the script, had no right to publish the script, at least during the period of your contract with the Texas Company. Mr. Leavitt and the Uproar Company, you of course realize, have gone to considerable expense in connection with the publication and sale of the Uproar booklet as well as in connection with the litigation against the Texaco and National Broadcasting Company. In view of the warranty made by you in the contract with Mr. Leavitt, dated October 1, 1932, to the effect that you have the full power to make the agreement and grant therein contained, I suggest that a conference should be arranged at an early date between you or your counsel and representatives of the Uproar Company with a view to making an adjustment covering the losses sustained by the Uproar Company under the above contract. Postmarked Boston, Massachusetts, July 25, 1936. Addressed to Joseph P. Bickerton, Jr., Esq., New York City. One 3¢ purple-and-white George Washington stamp affixed. Lightly toned, soiled and creased. Normal postal stamps. Paper clip impression and rust stain near center of envelope. Torn open at top edge. Otherwise in fine condition. Wynn had signed a contract with the Uproar Company on Oct. 1, 1932 to publish his radio scripts for The Texaco Fire Chief, sponsored by Texaco. Wynn implicitly owned the scripts, but signing the contract with Uproar damaged his agreement, also implicit, with Texaco that he shouldn't degrade or cheapen the value of the program. In other words, why listen to the Texaco-sponsored radio show when you can buy the scripts and their jokes from Uproar? Texaco tried to stop Uproar from publishing the scripts, so Uproar turned around and sued NBC and several other defendants, which they claimed were engaged in a conspiracy to prevent Uproar from publishing Wynn's scripts. The case went all the way to the First Circuit Court of Appeals, which ruled on Jan. 7, 1936 in support of a lower court's ruling that Uproar "is making a commercial use, wholly unauthorized, of the script...". On April 26, 1931, Wynn (1886-1966), born Isaiah Edwin Leopold, made his first appearance as Texaco's "Fire Chief" before a live radio audience. His popular radio series The Texaco Fire Chief ran from 1932 to 1935. He later starred in CBS's first Los Angeles-based variety show, The Ed Wynn Show, from Oct. 6, 1949 to July 4, 1950. The show won the first Emmy Award for "Best Live Show" in 1949, and it would also win a Peabody Award. Wynn won the first Emmy for Most Outstanding Live Personality. He later appeared as Albert Dussell in The Diary of Anne Frank (1959), which earned him a 1960 Oscar nomination as Best Supporting Actor, and in the TV movie Requiem for a Heavyweight (1956) with son Keenan Wynn.
